KEY IMPACTE – CONSULTANTS FOR DEV, Lda., hereinafter referred to as IMPACTE, respects the privacy of the individuals with whom it is related, recognising data protection as a fundamental commitment of its management practices, based on principles of accuracy and transparency. Protecting data subjects’ privacy is central to what we do; we value the confidence placed in us by sharing personal data.

In order to safeguard data holders, IMPACTE fulfills all the legal requirements in this matter, namely the provisions of Law 67/98 of October 26th, Personal Data Protection Act and (EU) Regulation No 2016/679 of the European Parliament and the Council of 27 of April 2016, on the protection of individuals with regards to the processing of personal data and the free movement of such data (General Regulation on Data Protection).

1. RELEVANT INFORMATION

The purpose of the Privacy Policy is to provide all data holders who deliver personal information to IMPACTE with the necessary knowledge about the organisation, use and management of their personal data. This Policy applies exclusively to the personal data that IMPACTE is responsible for collecting and treating.

KEY IMPACTE – CONSULTANTS FOR DEV, Lda., is a Portuguese company and subject to Portuguese law and it is established at Estrada da Circunvalação 3720, 4435-186, Rio Tinto, Gondomar and holder of the website https://impacteconsultants.com/ .

IMPACTE is the responsible entity for the collection and processing of personal data and in pursuit of its activity, decides which data to collect, the means of treatment and the purposes for which it is used.

2. COMMITMENT

IMPACTE is committed to:

  • Processing the personal data in a lawful and fair manner, collecting only the relevant and necessary information to the purpose for which it is intended;
  • Allowing the data holder to access, correct the information that concerns him or her, transmitting it in a clear language and strictly corresponding to the registered contents;
  • Guaranteeing the right to delete the data in accordance with the legal framework in force;
  • Not using data collected for purposes that are incompatible with the initial collection;
  • Keeping the data safe, accurate and, if necessary and possible, up to date;
  • Ensuring the consent of the data holder in accordance with the legal framework in force;
  • Respecting professional secrecy with regards to the processed data;
  • Limiting interconnections of personal data to the minimum necessary;
  • Implementing appropriate protection and security measures, which prevent unauthorized personnel from consulting, modifying, destroying or adding data;

IMPACTE ensures, among other aspects, the processing of data in accordance with the legal framework in force, by verifying compliance with the present Privacy Policy.

3. PERSONAL DATA, PERSONAL DATA HOLDERS AND PERSONAL DATA CATEGORIES

Personal data refers to any information of any nature and regardless of its support, relating to an identified or identifiable individual. Anyone who can be directly or indirectly identified by reference to an identification number or to one or more specific elements of his / her physical, physiological, psychological, economic, cultural or social identity shall be considered as identifiable.

The personal data holders are the individuals to whom the data belongs, who are professionally related or likely to be related to IMPACTE, as a supplier, permanent employee or as representatives of clients or partners.

IMPACTE may collect, store and use the following categories of personal data:

  • Contact information (name, address, telephone number, e-mail) intended to be registered in the general communication database;
  • Any other information that the data holder chooses to provide, namely in the scope of consultancy proposals or while participating in projects, events or training actions. The provision of incorrect or inaccurate data is the sole responsibility of the data holder.

Personal data provided may include, but is not restricted to:

  • Contact data;
  • Demographic data;
  • Professional data;
  • Personal documents in electronic format;
  • Requested and collected information through filling out online forms, according to the safety and security measures implemented by IMPACTE;
  • Data related to the services provided by IMPACTE in the organisation where it works;
  • Personal data available from publicly accessible sources.
4. GROUNDWORK, PURPOSES AND DURATION OF DATA PROCESSING

The processing of personal data is only permissible if, and to the extent of the occurrence of at least one of the following situations:

Consent: when, as the data holder, you have given us your consent, in writing or through an optional validation and if such consent is free, informed, specific and unequivocal for the treatment of your personal data for one or more specific purposes.

Compliance with contractual obligations and pre-contractual arrangements: when necessary, for processing of personal data for the fulfillment of contractual obligations in which the data subject is party.

Compliance with legal obligations: when the processing of personal data is necessary to fulfill a legal obligation to which IMPACTE is subject.

Defense of vital interests: in case the data holder is physically or legally incapable of giving his consent.

Performance of functions of public interest: when the treatment is necessary to the performance of functions of public interest.

The personal data collected is intended for the organisation, management and evaluation of the needs, interests and expectations of the data holder.

IMPACTE may also use your personal data to send information, including updates or changes to our services, and for changes to IMPACTE´s terms, conditions and policies.

Whenever there is no specific legal obligation, personal data is processed by IMPACTE only for the period of time necessary to achieve the defined purpose.

5. RIGHTS OF THE DATA HOLDER

In accordance with the applicable legislation, as data holder, you have the right to free access the data that concerns you.

Within the framework of its activity, IMPACTE may use partners and suppliers.
